Companies Need to Prep for a New US Trade Enforcement Reality

Parisa Salehi, Partner at Parker Poe, wrote in Bloomberg Law about how, "within a span of 24 hours, the U.S. government took two actions that signal a fundamental shift in how it plans to evaluate and enforce trade compliance."

"The Office of the U.S. Trade Representative proposed a sweeping action on June 2 targeting forced labor practices across multiple economies, using Section 301 of the Trade Act of 1974," she wrote. "The next day, the White House issued an executive order aimed at strengthening customs enforcement and closing long-recognized gaps in the system."

"Neither action is entirely new," she continued. "The U.S. has long used tariffs to influence foreign conduct, and it has long relied on Customs and Border Protection to enforce import laws. What’s different is the way these tools are being used together and the implications that flow from that alignment. This is a shift in how the government understands and approaches compliance, not simply a matter of increased enforcement."
